I have a abcd friend who moved from US to india while in the 6th grade and she regrets those two years of her life. If you have kids in school over here please think 3 times before u shuttle them back and forth.

First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.
Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.

I guess you are speaking like Tom Peters. But in the end, it all depends on where one wants to be and what is the world view of someone. If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. In my case, the request was processed at the local branch. I don't recall seeing an option on ICICI to do the wire transfer. But assuming there is, you should give that a shot. You might have better luck at the branch though .... RBI has the so called KYC - Know Your Customer rules for all banks and that may give you some leeway.
Did you mean the local ICICI branch ? I would appreciate if you could let me know the process that you followed to get the money from India.

Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.

Scenario1:
If you are on H1 in your 6th year with EAD (not used) then after 6th year will be applicant be on EAD or does he has to fill I-9 with employer
Based on how HR departments handle i9 forms, in most companies, they may not know when your h1b or EAD is expiring - some HRs may have calender triggers and request for updated EADs or h1b extensions. Usually you need to show the EAD or H1b extension with updated i 94 and they take a copy and place it in your file so that if there is an audit, they will produce the documents.
So it is your duty to inform your HR department that you wish to work using EAD after 6th year so that they update the i 9 form
Scenario2:

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

Now, the 300 number at San Jose is incorrect. There were around 400 to 450 people there.
When flower campaign started it was just a few people. They never waited for a large number of people before starting. Others were inspired by their leadership. This effort became huge, even skeptics joined in, smitten by the contagious enthusiasm of rest of the members. Same with San Jose rally. We just had five days to do it, 450 people showed up, that is amazing.
These two small successful events were instrumental in change of July visa bulletin fiasco. This clearly demonstrates that your argument about small numbers can't make a difference is incorrect. We have a past precedent of successful outcome based on a small grassroot effort.
As Andrew Jackson said, "One man with courage makes a majority"
Lets be leaders rather than followers.
On the other hand if you still want larger numbers than join us, we need your help. We have a Nor. Cal yahoo group where you will meet a lot of motivated people. Your neighbor was part of a 35 or so people who flew from California.

You really cannot ask for more EB3 numbers or 'treat EB-3 fairly'...Laws are made by the congress and they provided certain numbers to each country & category. USCIS has to follow these norms and apply those numbers and USCIS has followed the rule and have applied the allocatd numbers to EB-3. Problem is not that they are treating us differently or we are getting an unfair treatment. The problem we are facing is because we are just too many in number and the problem is Congress didn't make any laws to provide relief to people if one country or a category becomes hugely backlogged...unfortunately, the Last time they did any law for EB immigrats, it was in 1999 or 2000 when they brought AC21. Since then there has been huge surge in immigration but everytime anything immigration related legislation was brought in congress, it has been shot down..In my opinion we can get relief only if congress acts upon it, USCIS is working the way there were tld by the congress
Simple math can easily prove most EB3s will NOT get the GCs even in 20 years. And I'm sure the concerned may want to modify it so as to make it more efficient.

Questions:
1. What are the Consequences at Port of Entry on travelling with AP and NOT working for the ORIGINAL GC sponsor?
2. Can anyone share thier experience what was the outcome at Port of Entry when the answer is "NO - I am not working with sponsoring employer anymore" Were they held at Portof Entry indefinitely ?
3. What Steps can anyone take when at CBP office/Immigration Official is NOT allowing you to re-enter US on Valid AP (I-485 pending) and you are NOT working for sponsoring employer and no valid H1B?
Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.

"There have been some discussions on administrative fixes on immigration. " - Anything that is of interest for Legal immigration such as visa recapture?
Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.
Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.

My lawyer is saying that even if you want to file I-485 now, the USCIS has advised Fedex and UPS not to deliver any mail to that PO BOX. In that case I am not sure how one could become member of the class action law suit.

Good luck finding one that covers you till the end AND is low on premium! The cheapest premiums are that of term insurance, and it is intended for such situations where you have taken measures to invest in other places such as real estate, equities, bonds, cash etc, AND you are not counting on earning any return on the premiums you have paid.
This insurance is plain and simple. You pay low for covering you for a certain period of time - 10, 20, 30 years.
Btw, if one is 35 years old and buys a 30 year term insurance, you are covered until the age of 65. What is your point?

My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?
