THIS IS BIG AS 30-40% OF PEOPLE WHO WORK IN THIS CONTRY ARE RENDERING SOME KIND OF CONSULTING SERVICE TO THE CLIENTS. ALL DESI CONSULTANTS ARE DOOMED FOR GOOD.
In this country it is not the H1bs alone do consultanting/contract. Many staffing companies are there, and even individuals have their own companies and go for contract jobs. I have seen many prefer contract jobs because they make more money when compared to full time. If American businesses got used with consulting/contract even without H1bs, then why this department do not want to accept the practice. Why should small consulting companies get affected?

1. I created the thread under "Interesting Topic" which is specially created for this purpose: "to discuss non-immigration topics".
2. You can not have more than 1-2 action items on IV per month. They are simply not doable. Thats the reason moderators converted IV format and tried to make it like a communication hub for immigrant community. People can discuss and share anything as community over here. You may see job related public group to discussing movies threads. There is nothing wrong in that. You are 100% correct, all this pre-adjudication is a nonsense, knowing how uscis does things does anybody believe USCIS will not issue EVL in future, offcourse they will, how else can they justify there existence to continue recieving there salaries and pensions. This is such a joke, the whole idea of pre adjudicating would be that all the processing is done and when the date becomes current they can just pick the file and assign the visa number and issue the green card. But they will not do that, they will tinker with the application and issue an Employment verification letter, they will redo background check, they will ask for finger prints again........unending nightmare, I am not being synical just telling from past USCIS actions.
If we cannot get visa recapture, if we cannot get removal of country quota atleast we should ask for an administrative fix where once the application is pre adjudicated the applicant should be left alone and not issed any Employment verification letter rfe, or semilar\same job proof if they are back logged because of country quota and face multiple year wait, this way atleast it will give people some breating space, the way the system if set up right now, EAD, 485 pre adjudication, I140 approval are all useless if you keep getting Employment verification letter rfe and same semilar job rquirement. Without visa recapure it is going to take atleast 10 years for Eb3 and Eb2 india (eb2 priority date after Mid 2003), in the next 10 years you will keep getting Employement verifivation letter rfe and semilar and same job requirement, there is no way anybody can survive that for 10 yeears.
So guys and gals what do you think about it, maybe we are looking at it the wrong way, instead of visa recapture (I am not saying we should abandon visa recapture) we should also try for exemption of cases which have been preadjucated (485) from Employment verification letter RFE and same and semilar job requirement. Atleast this way even if it takes 10 years to get green card people will not have nightmares of being kicked out any time and with the stability they will invest in buying a house and spending which will stumulate the economy. Its a win win for everyone, for us EB immigrants, for the economy and also easy to fix as an administative fix. We have simpathetic people in Zoe Lofgren (Chair - Subcommittee on Immigration, Citizenship, Refugees, Border Security, and International Law ) she was instrumental in forcing USCIS to reverse there decision during the july 2007 fiasco and accept the 485 application. We also have Charles Schummer. It is not that big a deal to ask for exemption of cases which have been preadjucated (485) from Employment verification letter RFE and sam and semilar job requirement, there are people with from other counries who have got a green card in a coule of months to 1 or 2 years whereas people from India are waiting with priority dates from 2000 and 2001. Once you get a green card you are exmpted from any rfe or same and semilar job requirement, it takes more than twice the time to get a green card for a person from India that to get a citizenship for a person from ROW. because of the long delays with us being in this process for multiple years and having to wait another 10 years for green card we should request for rfe exmeption for pre adjudicated 485 applications. I am sure we will get a sympathetic ear from Zoe Lofgren and like minded lawmakers. These Employment verification letter RFE and same and semilar job requirement were not framed assuming it takes a person from India 10+ years to get a green card. There were framed assuming it takles 2 to 3 years to get a green card.
Lets be creative and try to work around the problem if we cannot resolve the problem directly, if we dont ask how will the lawmakers know this problem can be resolved by removing EVL RFE and same and semilar job requirement.
It is very likely that these pre-adjudicated cases may be revisited for further processing in future for cases with more recent priority dates. This is just my opinion based on the fact of the predicted slow movement of EB-I priority dates in coming months and next fiscal year. get your facts right first. India is not actively supporting sri lanka. It would be suicidal for india (especially considering nutcases like you that exist) to even think of that again. Sri lanka is using israeli uav's and chinese fighter aircraft and artillery to fight the ltte. In fact, india is at a strategic disadvantage now because we choose not to help sri lanka militarily. What do you expect to happen in a war? Rave parties?
Anyway hopefully, this will mark the end of the sufferring of both sri lankan tamils and sinhalese from now on. Both sides in that country have gone through enough already.

It is not good to put fake identity in any forums. The guy (MARPHAD) pointed out have a good civic sense. Here admins are not paid. They have jobs, and not always watching people. This site is for every one. So the members have an obligation to find out the fake, anti immigrants. He may not be anti immigrant, but he have fake identity. I think it should be based on how long they have paid tax (say 5 years). For example, for those who have been legally working for more thena 5 years and paid tax during the period, with labor and I140 approved, they should allow them to file I485 right away. :D
I always feel allowing illegals become legals is a huge advance for them. For legal H1Bs, the only advance of similar magnitute is giving them GC without any delay (at least within a timeframe comparable to those illegals becoming legals).

I took upon a couple of new employess in 2004 October and trained them for couple of months as per my job requirement. The company later laid off few guys and substituted two approved labors with these two guys. They got their greencards last year, while I am stuck with a F***ing 2003 PD.
I cant even say how mad I was over getting screwed like this, but hey, if there is any good left, maybe I will have my day too........

I personally know a case where 1-140 was filed in 2005, for a Labor which was approved as early as 2000.
The person was able to get his green card in 6 months time (he has been in US only for 1 year, came to work with the Indian company and joined this new firm just to get his substitute LC) and ate away 2 visa numbers which a genuine GC applicant should have got.
When there are applicants who are waiting for more than 5-7 years to get their green card and in some cases just to get through the labor certification process , isnt this grossly unfair?
Advocates support LC substituion as it is just one more avenue for them to make more money. Unscrupulous employers support the LC substituion since it helps them to make money ( as I understand many of these companies sell LC) . Also same LC is used multiple times.
The losers are genuine GC applicants who are ethical and companies which are ethical.
As a H4 visa holder my life in this country has been so very limited that even opening a bank account or getting a driving licence is tedious as most people have no clue about H4 Visa-its limitations including absence of SSN and donot acknowledge ITIN number for many of the above purposes.
We who are hindered by retrogression and the slow processing (actually no processing at all ) happening in the backlog centers should welcome this new legislation for Banning LC substituion.

Very well said & I just feel the same...I have already lost hope on this GC and can not predict how long its going to take but for sure before I leave this place and go back to home country I will contribute my best of share in this fight for justice and full support...count me in with out any doubt!!
If at all anything would work for recapturing of visas, its going to be lawsuit. There are already 155 ppl supporting lawsuit and saw ppl in are also thinking of lawsuit. I am sure there will be many more to support lawsuit. Did you get a job in US before you came to US. Most probably not.
There are a lot of people who come to US blindly like students or consultants. They also landed up jobs (doing what they were meant for and not as cabbies or as janitors) and built careers.
There are no or few body shoppers in canada because there are only a few shops :-D
For the majority this is true in US. This is what land of opportunity means.
It might be true for a few cases in Canada but for the majority it is false advertisement. Canada is not a land of opportunity. This is not a few of those who have been burnt talking. Try getting a job in Canada. Look at the salaries for yourselves.
Folks am again telling this for your own benefit only. I have nothing to gain. I was not wise to do that. So thought I would guide the poor wandering souls here. Dont waste your dollars in Canada PR when you have US GC pending. It will do you no good.

I disagree, I have friends who are DBA's ( oracle and DB2 ) , I know he has been working for $85/hr in canada from the past five years, there are lots of insurance , financial bank in canada, and also for SAP consultants there are excellent oppurtunities in alberta ( HUB OF OIL COMPANIES ) , I know lots of people are driveing TAXI but some body with experience should not find it immposible. Another friend of mine from INDIA landed directly in toronto, with only 2 years experience in .NET , with in four months he got a job.
So again if you do ur homework, you can settle down with ease in canada.

No matter which side you are on, the quota system sucks. Period.
1) Once you start receiving benefits out of being born in a particular country/ race/ sex/ religion, a notion of "entitlement" quickly builds up within you. This adversely affects your ability to perform, for you just don't have to work hard enough!
2) If you are punished for being born in a particular country/ race/ sex/ religion, you have no incentive to perform, as you won't get what you deserve no matter how hard you work!
How about this... during every Olympics, most number of Gold Medals are won by Americans. Now imagine a rule that prevents more than 7% of all Gold Medals going to people born in any one country. How does that sound?
I will myself hate it if athletes from India (who haven't won anything in the Olympics till date) started winning gold medals simply because other countries cannot receive more than 7%!

Agree with few points in your argument though overall it went little overboard. Whisky Line??? Are you implying there are no lines in US? Ever heard about GC Line???????:))))))I havent waited for 5 to 7 yrs in India for anything and not got it. Maximum I waited would be Tirupati temple for 12-14 hrs:)
I am only implying convenience is a big factor in deciding your future and your children future and where would you like to concentrate your energy/passion for the rest of your life.
I wouldnt mind waiting in Tirupathi line or waiting in line at Jai Mata di temple, for that the choice is mine. I am talking about lines which I have to get to or have my bahadur/driver/employee if I am in business do it for me.
Of course it sounds overboard but you wont believe the kind of lines (specially the close times) where state government dispenses alcohol. (new delhi is one of those).
BTW I forgot the Movie Ticket Window line (also the black line by the cycle stand LOL). I am sure I forgot a lot of other lines. The Key is Convenience for me.
Anyway don't take it too literally but I will give you a real example. I could never pay my electric bill for a commerical place even if I wanted to. There is a middle man. If you don't go through these middle men they will hassle you every month. Will come up with something so they can threaten you with a disconnection. Now at a business place and specially in service oriented business you cant fight them. For house electric bills thats not case though.
Same for sales tax guys, excise tax guys, ca's and lawyers. To get my IT clearance even after having every paperwork, commissioner (IAS) tip was Rs. 1000. forget babus and chaprasis.
As for your GC comments that is not the right comparision, as we don't require a GC in India. The closest would be Passport line (3 months to 2 years) and you have to bribe the enquiry man no matter what, and which state. HDFC Draft Line, Visa Line (after 40-100 days wait), Wrong passport picture run get new and go back to line. Not mentioning H1B sponsoring employer line.
:-) and I am not saying I am 100% right. You may come from a fortunate/honest town/village where there is still honesty and sincerity or Maybe one didn't face it as someone in their family was a bigwig, meaning every one knew (fiction) Anirudh is son of Income Tax Commissioner or Malaika is daughter of H P Dwivedi who is MP from Rohtak, Haryana. so for those guys it was sir, sir, sir all around.
but when Sachin hits a century or sets a world record.. Mera Bharat Mahaan. (India is great) Right? Sanya anyone? Right?
