I prayed god to get my GC before 2008.If God really exists I'll get my GC in 2008.If not it's a proof that God doesn't exists.
I'll have to wait for few more hours to prove.

If the legislations dont change - my estimate would be even more than 7 years (come on they already have 500k pending app before this 300k July2nd boom). In USCIS term It doesn't matter where you stand in line out of that 800K folks. The NSC july 2nd filers are speculated to be transfered to TSC almost 2 months down the line and no one has guaranted that our Original Receipt date of July 2nd be kept intact - How do you logically map this ??

So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.
Let me restart the discussion. I know we are all frustrated to the extent that we want to pack up and leave but we have invested too much time to do that. But let's assume things start moving and we get our GC's in a year or so. Having spent so many years waiting to "settle" would you be willing to unsettle your life again and start over in a country that you left more than a decade ago.
Note that I am not doubting anyone's intention or disrespecting any entry. Just wondering if its the frustation talking or there are ppl who would actually leave?

I have to agree with you on this. Its not like Bollywood did not make movies before Danny Boyle made one about slums and poverty in India. There were so many good movies made by Indians with not a single white or foreign contribution, but never even released outside of India. It took a white man to come and show the world the poverty stricken children of India that the world stood up and took notice.
My hope is that things will change now. Just as the world has realized the technical talent Indians have in IT and Business, my hope is that they realize that we have others talents too!
All said, congratulations to ARR and Pooktty. I hope Danny Boyle really keeps up his word to those kids to help in thier education.

I think Immigration Voice should stop this stupidity of catering to a community that cannot split $20 per month.
I think most members feel that things were going great without immigration voice when we were dis-organized, without any lobbying power and without an professional help.
I think most members are hoping that lawmakers will take pity on them at some point in time, and start working on their own so really why waste $20. How much stuff can $20 buy? Why waste it on Immigration Voice. Why not take your wife to a movie for $20. That's money well spent.
IV Core: Stop asking for funds and get back on with your life. Dont you have a life, a family, a job? Dont you worry about your own jobs when you divert attention from your daytime job to this stupid website and activities? I donot think I deserve $180/hr.... Right now I make $85K plus a 10% bonus.
You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.
My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.
if the difference is really that big than seriously i fail to understand it, they might be accounting for lot of other things like travel expense and other benefits that they might be providing but if the spread is as big as you are saying then it surely does not make sense. if this has anything to do with SOX then consulting company might be guaranteeing lot of things and might have legal liabilities if that is not the case then it is unexplainable.
although i strongly refute the possibility that hiring managers are eating money because just like any beauracracy few guys cant keep benefiting without sharing the benefits and no descent company will tolerate that kind of culture there could be isolated instances but when they are found out they are very severely punished and their life becomes that of a dog running from here to there because in most industries if you are working for a certain domain people know each other and reputation travels faster than light especially bad reputation.

There are people from India with PD 2005 whose I-485's have been approved lately.
I don't mean to sound dismissive, but I don't count as being a reliable source of information, since it is a tiny minority of total cases, and all information relies on user input - not the most reliable set of data, imho.
On the 1st page of "Country = india" and "case approved" there is 1 case that applied this year (feb eb2 with a PD of 02) - they were lucky. Everyone else applied before retrogression hit in 05 with the exception of a couple of eb2 with very old PD (00,01). 2 cases out of how many? 100s of thousands?

The number of available visas has not increased, the number of people that have applied for AOS has dramatically increased (either old or new PD). The visa numbers will be QUICKLY used up by those with old PDs, so those with newer ones will sit for a long time waiting for visa numbers to become available for their PD - they will become "pending visa availability" cases.

I think this is a very interesting topic. Neelima's story is about an American citizen of Indian origin. Since, she is an american she can choose to go to courts whereas we are non-immigrants with very few rights. If you are facing abuse at workplace the only solution for an H1B worker is to change jobs.
That having been said, this highlights a very important aspect of the american society (or rather any culture) in general. You can become a US citizen but unless you are a european (read caucasian) immigrant you will become a hyphenated american. You can spend all your life in US and you will still be referred to as Indo-American/Asian-American at various points in your life. Some of it will be generic comments, some of it will be racist. Infact, you will always face more harassment from your fellow countrymen (e.g. desi consulting/desi manager) in US than from americans. An industrialist from Punjab visiting US gave me a fine example of this. He said, we employ 75% labor from UP/Bihar because they are cheaper and subservient. We make one of them the foreman and he's the one responsible for getting the work done. The same thing happens in US, the first line managers are Indians and so are the tech employees. [Off course, some of the Indians have risen to great positions on the corporate ladder and that is a testimony to both their abiliity and the general open-mindedness of american people.]
The choice is yours. Do you want to enjoy the wealth of this great country and tolerate occassional racism or do you want to be in your own land and be not as well off?
On a lighter note, as far as curry smell is concerned, I have heard goray complain about curries, Indians complain about how chinese ppl stink up the kitchen when they heat food. None of the smells are offensive, ppl just aren't used to those smells.

Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
There are also Non-RIR cases that were applied in apr 2001 still pending in BEC. I personallly know few of my friends whose labor is still pending in BEC with PD apr 22 , 2001.

�United States Of America� or more commonly the �US� means one and only one thing for most people in India, the land of opportunities, a place where every dream comes true, a Cinderella fantasy that pops t life. Well, Legend has it that once upon a long long time, it used to be true. But the current situation is a whole lot different than the legends and the fantasies. Let�s delve into the story of an Indian guy, who set out on a journey in pursuit of his
dreams that promised him the sky.
This guy was a smart, hard working software engineer in his own power, working for a software company in India. He worked on different kinds of projects for different clients, all of which were from the fantasy land. The clients always appreciated his work and he had a great rapport with these people.
One day, he got an invitation from one of these demigods�, �Will you please come and join us and share our fortunes? We are in much need of someone talented like you to run our operations�.
Now, that was an offer he could not refuse, could he? It�s something he had been dreaming about, since he was a child. It seemed like an offer that would change his life for the better, in every possible way.
He immediately packed his bags, bade good bye to his family and friends, not knowing the future, not knowing he would not see them for at least a few years. It did not even remotely occur to any one at that point, that he will be tangled in so many restrictions, that it would be hard for him to leave the fantasy land. Well, who cares �He is going to AMERICA!�
He landed here, worked harder than ever, slogged like anything and proved his capabilities and reserved a place for himself in this wonderful land. Five years passed by�..not realizing that every day has been the same, just struggling to keep up with the expectations of his boss. However he became a much respected person at his work place, every one who worked with him was very happy to have him here. They just loved his dedication and passion. His initial plan was to stay here for the 6 years he had on his H1-B visa and head home. But, destiny had something else in store for him. His employers wanted him to stay. They realized they would not be able to find another person of his caliber. So they started a process called Green Card which would allow him to stay in this country and work for them.
He went to India after a long time, and met his parents. They wanted him to get married; he met a nice girl of his parent�s choice. Both of them liked each other and got married.
She flew to the fantasy land with him and they live happily ever after��.
Well, not exactly!
There is a twist in this story.
We need to talk about the girl for a little while now. She too was a young, aspiring software engineer with a good company in India. She was a smart and independent girl who loved to live her life. She lived at a short distance from her parents and family with whom she was very close. When she met the guy, she was overjoyed. She instantly liked him, but was a little apprehensive about quitting her job. But everyone told her that she was being silly and that she would get a job in USA, any time she wanted, because of her VAST two year experience. She believed it! The guy also did not know that his fantasy land had changed a lot since his going there. He thought that he was going to get his green card soon and that his wife would be able to work immediately.
So with all these hopes, they flew back to US of A. Here the reality was far from anything that she ever heard in the legends. She had no friends, no family, and no job. She was not allowed to work while she was on her dependent visa called H4. The hopes of green card were thrashed to the ground. Apparently only a small number of people were given these magical passes called green cards every year. And the wait was a very very long one; reality hit hard, it would take at least five more years to get their green card and that she would have to wait for an indefinite period of time before she could work again.
She thought of keeping herself occupied by making friends but she found none in her locality.
She wanted to put her technical expertise to good use by volunteering, she got a few offers but they were all so distant from her house. She did not have a car of her own, so she could not take up such jobs.
She was left alone at home all day, destined to look at the windows and the walls of her apartment. She could not take it. She applied for her own H1-B visa which she thought would allow her to start working. She had high hopes and started concentrating on honing her skills. But the process was such a long one that it took more than 8 months for her to get the visa approval. She tried to keep her cool, but it was one heck of a struggle. There were so many laws and rules and other incomprehensible things associated with her H1 and her husband�s green card process that she could not go to India to meet her parents . The real struggle started once she got her H1 B. She could not find a project to work on. There were requirements for people in her technology, but most of the jobs required hat she be one of the following:
1. Candidate with 6 years or more experience
2. Green Card holder with any experience.
She hit a roadblock. 6 years of experience or GREENCARD????
How will she get any of this now?
Her husband had also become very sad because of the pain that she had been going through. They were never peaceful during these past 1.5 years. Even he was also completely stalled in his career. There is a rule which doesn�t allow him to change jobs or take a promotion even in the same company once his green card process has been started. He has to either wait until he gets the green card or start it all over again. It is like leaving one�s place in a long queue and having to join in at the end, all over again.
I hear they are thinking about going back to India, where their lives will be much easier.
Two highly skilled people who were disowned like foster children and put entangled in such complex problems.
Unless they do something about this green card process soon, there will be many more immigrants who would plan to move back to their own countries.
It is America�s loss, no doubt!
An organization called Immigration Voice has been started by a few people, suffering skilled immigrants themselves, to take up the cause of all the others in similar situation. It has picked up quite a lot of momentum these days and

She lived at a short distance from her parents and family with whom she was very close. When she met the guy, she was overjoyed. She instantly liked him, but was a little apprehensive about quitting her job. But everyone told her that she was being silly and that she would get a job in USA, any time she wanted, because of her VAST two year experience. She believed it! The guy also did not know that his fantasy land had changed a lot since his going there. He thought that he was going to get his green card soon and that his wife would be able to work immediately.
So with all these hopes, they flew back to US of A. Here the reality was far from anything that she ever heard in the legends. She had no friends, no family, and no job. She was not allowed to work while she was on her dependent visa called H4. The hopes of green card were thrashed to the ground. Apparently only a small number of people were given these magical passes called green cards every year. And the wait was a very very long one; reality hit hard, it would take at least five more years to get their green card and that she would have to wait for an indefinite period of time before she could work again.
She thought of keeping herself occupied by making friends but she found none in her locality.
She wanted to put her technical expertise to good use by volunteering, she got a few offers but they were all so distant from her house. She did not have a car of her own, so she could not take up such jobs.
She was left alone at home all day, destined to look at the windows and the walls of her apartment. She could not take it. She applied for her own H1-B visa which she thought would allow her to start working. She had high hopes and started concentrating on honing her skills. But the process was such a long one that it took more than 8 months for her to get the visa approval. She tried to keep her cool, but it was one heck of a struggle. There were so many laws and rules and other incomprehensible things associated with her H1 and her husband�s green card process that she could not go to India to meet her parents . The real struggle started once she got her H1 B. She could not find a project to work on. There were requirements for people in her technology, but most of the jobs required hat she be one of the following:
1. Candidate with 6 years or more experience
2. Green Card holder with any experience.
She hit a roadblock. 6 years of experience or GREENCARD????
How will she get any of this now?
Her husband had also become very sad because of the pain that she had been going through. They were never peaceful during these past 1.5 years. Even he was also completely stalled in his career. There is a rule which doesn�t allow him to change jobs or take a promotion even in the same company once his green card process has been started. He has to either wait until he gets the green card or start it all over again. It is like leaving one�s place in a long queue and having to join in at the end, all over again.
I hear they are thinking about going back to India, where their lives will be much easier.
Two highly skilled people who were disowned like foster children and put entangled in such complex problems.
Unless they do something about this green card process soon, there will be many more immigrants who would plan to move back to their own countries.
It is America�s loss, no doubt!
An organization called Immigration Voice has been started by a few people, suffering skilled immigrants themselves, to take up the cause of all the others in similar situation. It has picked up quite a lot of momentum these days and
had been able to achieve success to a certain extent. But it requires more people, more funds and more support to actually attain a significant result.
America has been built on the competitiveness of highly skilled immigrants. America enjoys a technological leadership around the world primarily because of them.
Let�s hope that the government will do something soon to provide relief to these skilled immigrants lest America should become a mere legend like Atlantis.
