I guess our members need some education about different things like how the senate functions, voting system, & etc. Read more guys before commenting and bashing the politicians.
There is a lot of information related to legislation, and political matters posted by one of our members, Macaca.
http://immigrationvoice.org/forum/showthread.php?t=3317
That will save a lot of time for you and the other members.
BTW, this amendment was not ignored by IV. There was post on 7/18 alerting about this (the voting was 7/19).
http://immigrationvoice.org/forum/showthread.php?t=10537
If my guess is right, currently IV core is busy working on something bigger than this that they cannot disclose at this point.
So, to support the core, contribute as much as you can now, and in future. Once you get the EAD, after receiving the GC also.

Guys,
I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:
1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota
Yes. If you have a Advance degree in STEM + 3 years experience in U.S on H1b or OPT for F1 visa holders ( the experience is not required as per SKIL bill) AND have Cleared the LC stage AND have applied for and cleared I-140( with the concurrent filing going away) ,then you can file for I-145 irrespective of what the PD is at that point of time and irrespective of what your country of birth is.

I am shocked too. 2 members who I called on phone were abusive. They started blaming Aman Kapoor saying that he is rubbing his idealogies over already stressed immigrants - this was ridiculous and I am so sad that people have such thoughts.
If people are scared or want to live in Shadows why abuse IV who are truly committed for a cause???? These are the same people writing rubbish on those threads that ran 200 pages when they were waiting for USCIS announcement.

Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?
Can we get License renewed using EAD and not having H1?.

I agree.
I lived in Canada for a year. I also worked in my own country before coming to the US. At least in my experience and from talking to dozens of friends in Canada, my home country offers more potential for revenue than Canada. You will see it when you move there.
I will never forget when I landed in Canada in Toronto back in 1998, I met a girl at the airport and many at the Hostelling International who told me lots of stories on why I should go to the US instead. That particular girl was living in the US illegally.
I am sorry to tell you that leaving the US and going to Canada may not be a solid plan B.
Why don't you start a similar forum for "going back to
India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.
My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.
Cheers.

I was at USCIS this morning, followed every thing you suggested. My IO officer was actually a desi guy.
1) They completely refused to look at the received date, I had my EAD (765) receipt, but the IO said he only cares about the receipt date. I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge. His argument was " That update is in the over all scheme of things, but for EAD they have specific instruction to follow only the date they entered the data in the system"
2) I was not allowed to see a supervisor, the IO did talk to the supervisor but did not let me see her.
So they refused to acknowledge that it is pending more than 90 days?
They are technically right, the regulations say "within 90 days from the date of receipt of the application".
Talk about broken promises. Write to the USCIS ombudsman.

This is not even good for long term due to hefty financial charges of insurance companies, you would not know about this until you buy one ,my sincere advice would be do not even get into this crap in US. these guys rip you off.
As I mentioned before Prudential charged 70% premiums as a finance charge every month and only 30% went to savings. It would never make sense and do n't listen to people who never owned these products before.

Found this article while digging the New Article Thread -2
http://www.businessweek.com/technology/content/apr2007/tc20070424_967747.htm
1.A new report finds that U.S. demand for IT professionals in 2006 reached levels not seen since before the dot-com bust
2.The U.S. technology industry added almost 150,000 jobs in 2006
3.Unemployment for engineers, computer programmers, software developers, and other IT professionals is at the lowest rate in years. Less than 3% of computer systems designers are out of work and less than 2% of engineers are sitting at home searching the classifieds, according to the AeA study
4.There would have been a lot more than 147,000 jobs created here, but our companies are having difficulty finding Americans with the background," says William Archey, president and chief executive of the AeA.
5.One culprit is the dearth of U.S. engineering and computer science college graduates. Second, immigration caps have made it difficult for highly skilled foreign-born employees to obtain work visas. Congress has been debating whether to increase the numbers of foreign skilled workers allowed into the country under the H-1B visa program
Also the following article talks about the taxes conrtibuted by the legal coummunity to New York.

PD - Sep 2002
Labour Certification approved - May 2005
I-140 - Not filed yet
I am about to file I-140 (PP) and I-485 concurrently beginning of June.
But looks like the the May 21st cut-off screws it up completely.
I have heard someone say that I might escape the new law if I get a Green Card before the law is enenforced on (10/1/2008). Does this assumption even hold any ground? Doesn't the proposed bill say that anyone who has filed I-140 after May 21st 2007 has to reapply regardless of where he is in the process.
Gurus please advice.

There is nothing to discuss on this. Just take the cash to any national bank SBI or ICICI or UTI and ask them i want to wire trasfer to US bank account. They ask you to fill up wire trasnfer form by giving US bank accout and routing numbers. They just do it by taking some fee for wire transfer. Thats it. You will get into your US bank account in a day. Thats for sure. I did this number of times. I don't know, you guys make it complex everything, by saying NRE/NRO/RBI etc. It just damn simple, do wire transfer.
I know this is possible although I did not try this. I think you need to get a certified letter from CA. But can you give the money from your account and again have them gift you ? I mean wouldn't the bank check this is the same money that you gave to your parents previously.
Btw, you can get upto $100K from your NRE account without RBI's permission. Also you deposit your Rent, interest etc that you get in India, into the Repatriatable NRO account and repatriate here in USA.

If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.
If not all, many of you are in the similar situation.
My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.
Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).
Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.
My $200 contribution is just 0.4% of that another lost opportunity.
Now you know why I support this effort.
Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.
Thanks,
nviren
