As they just started I-140 premium processing, I wonder why they cannot initiate 3rd stage premium processing.
I wouldn't mind spending a couple thousand dollars if I can get the actual green card in a couple of weeks after starting the 3rd stage. Time is money. If I can buy it, I will buy it.
I don't think it is very constructive to repeat the same story to the congress, which they are not tuned to. We'd better make various suggestions from many different angles so that they can pick at least some of them in a timely manner.
The last stage is already messy when USCIS made everything CURRENT and everyone filed whether visa numbers are available or not.. Do you want to add more to it?

Hi,
I am Indian national on H1B, waiting on priority date to be current to file for I-485. My wife is currently working on TN visa. Will there be any issue with her being on TN status when I file for adjustment of status (for me and for her together). What options I can consider in advance so that I-485 process will not halt with last minute surprises.

Hi ,
I was on F1 visa till oct 2008 and then a consulting firm file for my H1B . It was approved and my status has been changed . I tired a lot but i didn't get any project and i am on bench till oct 2008 and i am still on there H1B. Although in the mean time i was enrolled in school and never quit the school as i am working on my project in school and i always had valid I20 and valid I94 and F1 stamped on my passport till dec 2011. I am still enrolled in school.
Now my emplyer is saying to file COS and go back to F1, but i don't have paystubs and he is not giving me as he said being a bug company we dont do this.
I talked with a attorney he is filing my COS.
1) is there anyone in the same situation evr ?
1) Is there any other way i can follow?
2) what percent are there chances that my COS will get denied or accepted?
3 ) My employer is still marketing my resume?
Any Suggestions welcome!!

Its not advisable to go without pay stubs. if you are in H1 and no salary means out of status. With out of status you can not go for COS to F1. The best way is to get the pay slip.

I received a notice from uscis

We have the same situation. I am the primary and got my GC last July. Spouse still does not have it. We have a PD of Sep 2005 and 485 RD of Sep 2005. No idea what is happening. We also have contacted our Congressman, Senator, and done Infopass and SR. Our case was originally filed at VSC, transferred to TSC and is now at a "USCIS Office"

My husband was approved in August 2008 and I am still waiting after infopass, etc, etc...
I just want to start a thread for folks whose primary applicant is approved but derivative is pending. My case was approved on July 8th, but my wife's case is still pending. Here is the complete list of steps that we have taken.
1) Created an SR on 07/09/2010 (No response yet)
2) InfoPass appointment on (07/16/2010); Reveals that case is pre-adjudicated.
3) Submitted form DHS-7001 (07/19/2010)

Very shallow DOF is a factor of Macro photography. Use the smallest f-stop you can and focus on the nearest plane. Experimentation is pretty much a necessity with Macro work.

Hi All,
I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

As far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........

If it is a profit based company then you are no more cap exempt. You have to file a new H1B asap.

total time in labor with news paper advt and all buffer is 6-8 months. I140 take another 2 weeks in premium processing. so in all 9months approx. that should give further extension on H1b.
Also even if previous I140 is revoked, you can have your PD attached to this new labor during I140 application.

Not much happening in this shot. Seems like it needs a bike leaning against the wall, a bench, a red pot, something to give a focal point. Either that or a shaft of sunlight down the street. I'm bothered by the leaning wall on the right. Makes me feel like it's going to fall down on me. Two potential shots I see in the scene are the door and grillwork next to it, if you can get the right light on them, and the hanging plant. Tough to shoot narrow streets like this when there's strong sunlight above but the streets are all in shadow. Did you try other angles/perspectives when shooting this? If so, they might be worth looking at.
Played with the image a bit in Photoshop to see what I could get out of it. Not sure I did much but I'm no expert, particularly with curves. Maybe someone else can do better. A black-and-white version also might be good.

My company has just changed the rules. From now they are unwilling to pay the costs incurred in the visa extensions for the spouse.
Is this legal? Does anyone have any links etc that I can pass on to HR if this is illegal. Thanks.

I have a situation where I can not find proper information and would like to ask all the experts in this column.
I'm on H1B visa and have valid visa till Dec 2011. We are about to file I 140. My PD is current and I would like to do the concurrent filling. But I need to visit my home country next month for important engagement. And do not have time to get AP before I travel. I appreciate if you can find answers to my questions.
- Can I reenter to USA on valid H1B visa when my I485 is pending (without AP)?
- If so, Do I need to go for another visa stamping in my home country? (I have a valid visa, but was stamped in Mexico) & Will there be any issues for I485 application?
