    EAD Renewal's are eligible for premium processing, so if you really need a renewed EAD to change a job, it's almost comes down to paying an extra $1000 to get it within 15 days. As far as a new EAD goes, USCIS will have to process it within 90 days. Now that they have stopped issuing Interim EAD's , if you go to to the USCIS local office after 90 days of filing the initial EAD applications, they are obligated to come back to you with an answer on why your application has still not been adjudicated. If you do a google search on interim EAD termination, you will find a couple of links about some law firms planning a class action lawsuit to dispute this. This is still not an issue because most people get their EAD's within 90 days, but you can almost bet your bottom dollar that there will be a hue and cry( read class action lawsuit ) if the first time EAD's get delayed more than 90 days because of administrative delays for reasons such as backlog.

    Where did you find the updated Renewal Form, I saw an update in Murthy.com, we need to use the latest for for I765

    and How much was the fee(Check you sent)

    This is the correct process of EAD renewal.
    - get the latest form always from http://www.uscis.gov/i-765
    - never use google or any search engine
    - since my first EAD was filed before the new changes implemented last year (i think july 2007), I had to pay $340. I think everyone has to pay $340 (Your case may be different, read the instructions properly)

    This now will give me a 2 year EAD. and even after 2 years If I dont get a GC, I will be able to reapply for EAD, at that time WITHOUT any FEES!!

    Bottom line is : Read the instructions properly.

    May I add, these posts are very much relevant here as these kids are immigrants and their kids. They might become an entrepreneur or scientist in the future and it shows the value of the skilled immigrants.

    We need to come out of our EB2/EB3 narrow mind and how it's going to help me today.

    You just hit the nail hard on its head -

    1. yes, our employers pay big bucks to keep us employed and guess what, that will pay for the USCIS work force to legalize the undocumented workers. Isn't it good to have 300,000 people paying 2000 dollars each every year to extend H1 - such a nice revenue stream, and a great business idea. Guess how many Ameican jobs it creates?

    2. Oh btw, you keep paying SSN and Medicare like other educated workers and then if you are unlucky which a sizeable percentage is, you do not get a dime back. I hear a lot of SS going bankrupt etc., but hey, even in the worst case scenario, they talk about reducing SS, not abandoning it. So, you subsidize the older Americans but no one susidizes you when you are old.

    I think some politicians actually like our problem, we will always do things legally and it is easy to screw us as we are documented - they know who we are. Some employers (not all) like it because it i a great way to tether someone for eternity in a particular job. It is a win-win situation for these politicians and employers.

    But then there are other politicians who think of the long terms effects of taking advantage of legal immigrants, and they try to help our cause. And other employers who get scared that the best ad brightest will realize they have better opportunities else where and leave.

    Let us see which camp wins.

    there is no employment allowed on H4. Please check with your lawyer as you might have problems with canada stamping

    she has never worked on H4. The problem is that she has not worked on H1 either and I am thinking of changing her back to H4 to be safe.

    within country applying for change of status is not safe, cause she is out of status without any paystubs.

    the only 2 choices I see are ask employer to generate paystub and switch to H4 or else leave country and get a brand new H4 on the passport. But was wondering even in this case will they question about previous visa status history or will they just look at my pay stubs so far and grant her a H4. And if doing this in canada is a safe option or not.

    R u sure about this.. I know that as of yesterday VA DMV was issuing licenses /permits to H1-B holders without anything you mentioned...I am not sure..but every state has different rules for license issue and there is no national policy for this ???

    welcome to the world of retrogression. it is only going to get worse from here on out.
    with the deluge of filings in june/july and aug. this year....the retrogression will get worse. USCIS will not make the same mistake again.

    How the hell can all the catagories after EB3 be current yet EB3 be back logged???? By rights they should be unavilable until we are current.

    This is just so unfair.

    i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...

    I want to become a believer in your 3.a. statement... please let me know what you think.

    If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.

    In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.

    Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

    chandrajp, many times it's not because of rules. It is common courtesy to go to a cafeteria if one is available. Smell of Indian food in general (it's a fact not criticism) may have a distracting effect in a work location so it should be eaten in a cafeteria (if available). Also, we need not emulate other people's lack of courtesy and do the same thing (like some people quoted Americans eating burgers in their cube). If we have the option, we should eat in the appropriate location.

    In addition, with respect to discrimination, I do not condone it at all but we need to do a reality check for ourselves as well. I have never worked in India since I left the country 10 years ago but my friends working in India have told me how their managers have humiliated them by speaking in a regional language in meetings that they didn't know. So wherever there is a difference of culture, language etc., unfortunately human beings tend to behave the same i.e. discriminate against others who are different from them. For example, how do we explain the 'Fair & Lovely' ads? It's blatant discrimination based on skin colour.

    Discrimination should be done away from every aspect of life.

    In November 2006, Secretary Chertoff discussed a risk-based approach to homeland security threats, vulnerabilities, and consequences:

    [T]he core principle that animates what we do at DHS . . . is risk management. It is a recognition of the fact that management of risk is not elimination of risk. There is no elimination of risk in life, and anybody who promises every single person protection against every threat at every moment in every place in the country is making a false promise . . .. What we do have to do is identify and prioritize risks -- understanding the threat, the vulnerability and the consequence. And then we have to apply our resources in a cost-effective manner, using discipline and common sense in order to minimize the risk without imposing undue cost on our communities and our families.

    Despite Secretary Chertoff�s continuing emphasis on risk management, USCIS performs FBI name checks without the benefit of risk management modeling. In recent visits to USCIS field offices, a number of leaders have questioned the usefulness of the FBI name checks citing some of the same concerns discussed here. The process is not working and consideration should be given to re-engineering it to include a risk-based approach to immigration screening and national security. The U.S. Government Accountability Office recently noted in a report that �[w]hile the Secretary of DHS has expressed a commitment to risk management, DHS has not performed comprehensive risk assessments in . . . immigration and customs systems to guide resource allocation decisions.�

    Every effort should be undertaken to identify and remove persons who pose threats to the United States, which would include rescinding immigration benefits after USCIS has granted them. It would be irresponsible for law enforcement entities to stop their investigation of a potential crime merely because the person who is the subject of their investigation has obtained a green card or U.S. citizenship.

    Similarly, it would be illogical to think that delaying issuance of a green card or U.S. citizenship will prevent a criminal from committing a crime. Considering the protection the FBI name check provides, the cost of government resources used, and mental and actual hardships to applicants and their families, USCIS should reassess the continuation of its policy to require FBI name checks in their current form.

    Ok. One more red rep with the following comment

    People make their own purchasing decisions based on their comfort. On forums, you just need to read and follow your own gut.

    Also, there is a talk that when US dollar currency weakens considerably from the current levels, foreigners may be interested in owning real estate in US.
    Also, US being a tourist destination for many countries Hotel sector may start booming.
    However, if foreigners want to purchase, US must make considerable changes to their immigration policies to invite.

    There are way too many problems infront of Fed Chairman.

    1) Asking people not to walk out of homes and pay up their loans
    2) Making the wall street firms like Lehmen, bear sterns run their businesses as usual.
    3) Contain the inflation so that long term interest rates are lowered.
    4) Come out clean if the US policy is shifting towards Weak dollar or going back to string dollar policy. Either way US and world over have to face gyrations in near term.

    There is blood on everybody's hands for the mess we are in.
    1) Japan for too long provided the world with cheap loans (~1%).
    This money not only found its way to corprate India but also into US
    Housing markets.
    2) Americans spent money much much more they earn or worthy off.
    3) Globalization created another affect (Read Alan greenspan's 'economic conundrum' theory). Google it, you will find plenty of articles.
    4) China for too long manipulated their currency and provided the world cheap goods.
    5) Oil exporting countries didn't utilize the profits in developing their countries and economies. Instead they started buying aasets all over the world causing unsustainable price levels in asets.
    6) Indian software industry far too long booked profits without developing/diversifying into enterprise strength products and remained fixated on their business models. Software sector is staring clueless and is unprepared for the fallout of outsourcing industry. Pink Slip culture is on the rise.

    How do we come out of this financial mess in US?
    There is no easy solution.

    10,000 people buying homes will not help this economy. On contrary, 10,000 people not buying homes will help.
