I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.
I tihnk all these efforts do not define a common cause right now.

Like RAgz4u said, with a tight rope walk, it will be extremely difficult to get our amendments to pass.
Without that, even if the bill pasess and lets 12 million undocumented
folks get in the line, it is drastically going to clog USCIS which
may screw us up badly.
So what good is the CIR if our amendments dont get in ? Seriously....
Maybe we are better of without the CIR if our amendments are not in it.

While AP entry officer Stamped date one year back on my I 94 and AP Doc.Which means my stay was already expired before entry . Thank god I verified all dates before leaving counter. He changed it immediately. My advice to guys check it all before you leave counter. You never know which things can come back and haunt you.
you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...
I am sorry you had a bad experience...possibly because of the officer's ignorance...worth a complaint...maybe you can draft something with your lawyer....don't just ignore such bad behavior...

Hi Guys,
I am a July - 2007 filer and we got the FP request in July for me and my Spouse, I have not applied for any EAD or AP extensions recentlly, for a side note i have to travel out side US in July and my attorney requested for FP reschedule (which was actually scheduled in last week July) for atleast 6 to 8 weeks, but USCIS sent me the request with in a week with an FP date just 3 weeks apart from the original one..so i had to rush my things and had to come back to US to get the FP done..
I just called TSC and got a helpful IO. He explained me that the FPs for my case are expired as those were done in Nov 2007. He issued a request to send another FP notice, not sure what help it will do at this time. He did tell me that my case is preadjudicated but also mentioned that preadjudication means nothing more than that a legal clerk or junior IO has reviewed the file and everything is order, in other words according to him preadjudication does not mean approval without any review.

I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.
However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

EB migration was a added almost as an after thought to the family based immigration bill. Current or future considerations were not taken into account when they wrote the bill, the prime focus was (is and will be) the family based immigration as they get the most votes, they have the most 'heartbreaking' stories. I understand your point. I also dont want to argue about how USCIS distributes overflow. I have been dealt a hand i am dealing with it.
I do want to say that nothing will happen unless you make efforts to make it happen. We need to talk to the lawmakers about our problems. Half of them still think we are talking about H1 and launch into a spin about outsourcing. The H1 lobby has major companies backing them, anti immigration groups are flush with cash and are very vocal. Hispanic caucus is a big group. What about us, do we just keep discussing issues or try to educate people on our problems...if we dont we will stay a minority with no voice, simply pawns used and abused by others.

Each of us need to send their local senators a stopper and a personalized memo saying 'tax paying legal immigrant since year <ur year of entry>..no green card because of country cap limit and visa number wastage each year by USCIS..We would want congress to pass a legislature to recapture the unused visa numbers. We are NOT asking for H1 increase.. The reverse migration is already in progress and might become severe without any congressional inaction.'
This could work because we have atleast 2000 active members and there are around 100 senators. If each of members could send a stopper(cost around 10 dollars each) to two senators, each of the senators would receive forty to fifty stoppers. It will atleast gain us the much needed Media publicity.
The problem with us is most of the members don't want to show up in public. I hate it but to make thousands to walk on streets it takes a lot of money and effort and at the end not many people would show up.
I know I am ignoring the house representatives completely..but we make enough noise with senators it might just serve the purpose. Moreover, I think te house is not that against legal immigration.

Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

Next time someone questions IV's efforts, I am going to bluntly ask them if they contributed or came for the advocacy day event. If they did neither, we do not need their 2 cents of free comments.

While I am happy for you and your success along with your spouse, I personally consider it as being at the right time in right places making decisions that were in your reach. I do agree that you did lot of planning. Most of the people here run on one income and spouses on H4/F1. So they dont have the edge you had/have. I might sound harsh in saying this but the matter of fact is that the 2 incomes lead to savings which lead to buying a home(s). 1 income, you wouldnt have done all these by yourself. I know several people with 2 incomes and most of them have done this :) Those who havent were the kind of folks who are happy having their 100K in bank rather raking up 200K in equity. I am sure there are a lot of things you can do with a US Citizenship.

I feel that this forum is totally going in a direction where people are seeking some sort of solace in discussing stuff that doesnt directly relate here. Now that all of us had discussed about what we can do with a GC can we streamline our effort to what we can do to get a GC.

US economy is designed this way, everyone will get their own share. No one bothers about optimizing the chain and reducing the cost. If they do that whole economy will collapse. My current EAD expires this Friday. I e-filed on May 5th. Infopass after 90 days did not help. They approved my expedite request on 19th and said I should hear something in 14 days which is another 5-6 days.
I did contact my Senator (Cornyn) who actually offers to help with time-sensitive problems with federal agencies. This was about 2 weeks ago, even before I submitted my expedite request. I'm going to give them a call tomorrow to see if they have heard anything.

I agree with you 100%. I think Anti-Immigrants like NumbersUSA and Tom Tancredo is better than USINPAC. For Anti-immigrants atleast we know where they stand and we know what to expect from them. usinpac is the worst kind of disease for the community where they can trick you anytime and you will not even know when they are stabbing you at your back. They just want to do photo-ops and claim the credit for the things they didn't even know. I live in VA and most people in Indian community in northern VA know about the inside story of these scamster. Initially a few lawmakers got the impression that usinpac represent the Indian American community, maybe that is what the con-artist at this org conveyed to a few lawmakers. Now everybody in DC area, including the lawmakers, know the truth about this group. A journalist friend in MD told me that even press and reporters know about this totally useless org called usinpac.
It is one thing if they do something and then claim credit for doing it. The problem is first of all they claim to represent entire Indian American community; on top of that they do not do anything about the any issue including green card issue. But when they see something happening they will try to take ownership of anything moving and will try to make a show that things are moving because of them. Just as in this case, all the members of IV sent flowers and these guys are releasing press release to tell to the world that they are the once doing this drive. Such press release from them is extremely damaging as the basic intent of the ENTIRE flower campaign was o draw media attention. In this case usinpac did not spare all the people spending days and nights to coordinate, Nixtor and English_august and thousands of people who sent flowers. How can someone stoop so low? Now they want to get media attention and that is why they have sneaked in this press release. IV core must come clean on this and clearly renounce these consistent immature acts of these con-artists.
