[QUOTE=gc_in_30_yrs]Can we get the copy of I-140 Approval Notice under the Freedom Of Information Act (FOIA)? If so, please advise the way to do it.

Is itn't surprising? I got a letter from USCIS today! 2 1/2 months later!
It is said in the letter that this request is very complicated one, so it may take some time to work on. Once they get a handle on what to do about my request, they will start working on it. And on top of that, it is in a queue, meaning there is some backlog (you want to call it retrogress???).
i will post more information once it is available.

Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.
I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!

Kaka you really have a win-win situation. If somehow something gets passed in lame duck then you will be happy with your GC. if nothing happens and priority dates don't move forward then you can always tell others " I told you it is scam and you did not believe it".
When I said this is a SCAM and they just dont want us to have Greencard. Everybody got mad at me.
Lets see when we will get GreencardsGod Knows.
KAKA will not say anything

Is it a guaranty or just assumption that we get GC in few months if we pool $300 ??? sounds to me is a guaranty.. can you back this up with reasonable explanation????
Sorry, if I did not state properly. I did not mean it and there is no guaranty. But if we have more money, IV core can go ahead and lobby with full force.
Apologize for the miscommunication.

I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.
At the same note,I regret for not being at DC after meeting some of the members yesterday.
Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now !
Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.
I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a favour to any one!
Come on folks, join ur state chapters.

I would further say, what is the difference between you and anti-immigrants in this matter ? You are saying that certain class of people should be kept out of the job market and you have your reasons. Since you are probably US educated, you want those who are non-US educated out of competition. Do not give me the BS reason that those with non-US education are the only ones that fake their resume. As far as faking the resume goes, or bragging goes, its up to the individual. It could be anyone, including Presidents that fake resumes or pad it with embellishments.
The anti-immigrants are saying that they were born here so those who were not born here should be kept of out the job market to reduce competition (and spur wage inflation, which they would call fair wages, but its really wage inflation, the kind that drowned GM and Chrysler).
Would it not behoove you to say that the decision of who should be hired and who shouldn't be hired must be deferred to the employers and not the Government or any other special interest ? As an employer, are they not the most capable party here to make that decision and evaluate their options ? Shouldn't people who create wealth (employers, businesses) have the prerogative to decide who they want to hire to help them create wealth ?
Logiclife - I totally agree with your opinions.
Me and my wife both are professionals - in different fields - none from ivyleague - we decided not to force our kid into something but to allow her to carve out her own career through her interests. We do not aim for sky , but definitely have vision to grow and become successfulaand strive towards it.
From all those people who went to school with me - those ivyleagures are still in jobs - kinda secure jobs and they also secure their jobs - one of our C grade classmate who was average mediocre and just did a BA degree is now a very successful entrepreneur - he is big time into infrastructure development and also sponsers a team in IPL

That doesn't contradict anything I said. I was referring to the 38 occupations where you do not need Canadian work experience. I agree that the list is much more restrictive than before. The other way around it is to have a job offer. All I said was that Canadian work/student experience is not mandatory.
I get it....they will keep tweaking it...if too many start applying with the HRDC approved job offer then they will crack down on that.
It happened to H1B to EB2/3 GC thing as well. In early days people even with MS could get Eb1 till there was court case after which
the requirements were tightened.
Now with PERM even EB2 is becoming harder.
The problem is that more people want green card than what the govt wants to give. So they try to come up with filtering criteria
in a varierty of ways...tightening the rules, country quota (in case of US). visa post processing quota in case of Canada etc.

not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). .....Cheers
Its a wrong fallacy to assume that NOs = people who dont want to part with their money at this stage. Let me put it this way for you with an example :-
Poll
1. Yes I want e-bill to save tree.
2. No I dont want ebill and I care a damn about the trees
3. Dont Care
The above poll is a loaded poll favoring one option only. Is the only reason someone may not want ebill is that they dont care a damn about the trees. NOPE. It can be a lot of other reasons - they may feel not so good about internet security or may not be internet savvy. And of course, paper bills can be on recycled paper and whole lot of other arguments are not covered.
Similarly your poll is very much loaded.
And again, you havent defined "more". Currently, I believe the contribution limit is 25 dollars per month. When you say more - what number are you thinking of. And now look at the folks who said YES. What numbers are they looking at. If you had put in a number and said "are you willing to pay x dollars per month .." - then you can be assured of that the members who say YES are on the same page as you. Right now, what you have is a number of folks but they may not be on same page.
And what is the definition of "updates" ? We are not working here on a fixed time project where the deliverable is due at the end of period 'x'. For quite a lot of period, the updates will be generic and on the lines of "we are working on getting to our goals and we are making progress". You will not get any more details than this. Turn around and check with the folks who said YES -- is this what they are expecting. Or they are expecting something different.
25 dollars per month equates to 0.6 % of annual salary for someone making 50k and only 0.3% of someone making 100k. Is this a big amount - Yes and No. It clearly depends on the individual. For lobbying you agree that the amount required is way more than what we currently are able to raise.
IV has probably 25k+ registered users. This is a good number to look at. Practically, how many of them have logged in and used this system for the last six months and three months and last month. I dont know the exact number but have a strong feeling that this number will probably in the 10-15 percentile only. And guests is not equal to an unregistered IV member. Not every person posts on this site. There are a lot of people who just browse the forums and dont post - they dont need to login everytime they come on to this site - therefore you will see a good chunk of visitors but they necessarily are not unregistered members.
Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

It appears that you are cracking a joke, but I cannot stop from replying to your post. Why are you asking God to save IV? For the things we cannot do or for the things we dcon't understand, why do we always have to bring in 'God' in the picture? Can't we even crack a joke without brining in God?
I am just trying to prevent world war III on these forums. Thats why my request for not referring "God'. We will all be much more happier funnier and peaceful if we try not to bring in 'God' in the mix.
Next thing you will see, someone will post - "God, when will the VB dates move for my category".

We applied for my wife EAD/AP on June 7, 2010 (E-file)
Her EAD was approved in few weeks back but there is nothing on her AP.
Her LUD change was on 6/11/2010 when they issued the receipt.
We called USCIS and initiated SR. Still no change in LUD.
Infopass is not a great option for us (3 hour drive one way). Any help is appriciated.
(We used to have POJ trick for calling NSC IO directly,
Does it still work?
If yes, what are the steps?)
Thanks in advance.

Hey guys,
I have a question to all of you...
AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.
For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.
I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...
Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .
Please post your 2 cents ...
Thanks !

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

What Raj is saying is get your GC first and process your wife's through family based which would take a very loong time...10 years!!!
Now to my views..Your wife will be able to piggyback on your 485 application irrespective of her status H1-B or H-4 or F-1..She's your wife PERIOD...no problems there!!what i don't understand is this bangwagon "lets apply ours first and include our wife's petition later when PD becomes current"...Instead y not apply both petitions together when PD becomes current again!!Atleast you wouldn't have to worry what if my petition gets approved b4 my PD becomes current!!!And god knows how many years of H1-B extensions they would give you once you have your applied 485 receipt!!!At the end of the day it is your choice!!!

So you think we can only Plead? I agree.
What special do we have to offer that makes us important than CIR?
Ask yourself
Votes: no
Contribution: no
How many of our employers are pleading for us?
How many citizens are pleading for us?
If you say we are paing taxes so we should get greencard. That does not make sense. We are using roads, hospitals, infrastucture of this country and we pay taxes as long we live here.
If you say we invent new things, start Google etc then these people qualify for EB1 and it is always current.
If you say we have USA masters then we can apply in EB2. EB2 will get current next year or its wait time is going to decrease and will be 2 years max. So 2 years or less is a reasonable processing time within a 6 year H1B processing time.
I am playing devils advocate here and trying to tell you to think beyond pleading. We did not come to this country to plead. Once you start thinking negative there are many negatives as I have written above and you will go in depression.
Who is stopping you from Meeting lawmakers? Have you done that?
Who is stopping you from contacting media? Have you done that?
Who is stopping you from contacting your CEO of the company and ask for help? Have you done that.
Who is stopping you from contacting organizations of Indian American citizens and ask for help?
Who is stopping you to do rallies everymonth on weekend in every state. Why are we not doing it if we are so depressed with Greencard.
Who is stopping you from contributing to IV?
Who is stopping us from doing lobby days in DC once every month?
Why can't we do. I have tried to do at least one item in this list. If we all at least pick one item, it will be enough.

Thanks for your comments. Constructive debates are good!
From my side, I have done a little bit - contacting law makers, sending letters, contributing / collecting amounts from friends for advocacy...
I work for a large corporation and did talk to them seiorusly. They expressed their sympathy :) :) :) Nothing more !!!
Unfortunately we do not have unity and most people have either resigned themselves to their fate or expect others to work for them.
I humbly disagree with your opinion on EB2 becoming current. I think it will take 10 - 12 years to cross 2007. I do not wish for it, but that is the reality [assuming a vey high % age of porting (everyone eligible has a right to port, I am not questioning that)]
It is unfortunate that we do not the money or vote power. Like it or not, we have to follow the beaten track of "Prayer and Petition". Non US Citizen kids have to pay International college fees even if their parents have paid local taxes for 10 years. That is pathetic! I know people who had to separate from their families and send their familes to India as they could not afford paying International tuition fees which is about $ 45000.00 per annum. This solely affects Indians / Chinese. This literally makes you an outcast just because you do not hold a GC! Just think of some of the hardships people are facing.
If people from EU were to be back logged like Indians / Chinese, things would have been different!
I stand corrrected if I am wrong!
May the SUPREME POWER bless the EB2 / EB3 folks waiting ....for their GCs!!!
